Terms and Conditions of Use for the USPS® Fingerprint Capture and Submission Service on Behalf of the Federal Bureau of Investigation

PLEASE CAREFULLY READ THE FOLLOWING AGREEMENT BEFORE AGREEING TO USE THIS FINGERPRINT CAPTURE AND SUBMISSION SERVICE PERFORMED BY THE USPS ON BEHALF OF THE FEDERAL BUREAU OF INVESTIGATION ("FBI").

This Terms of Use Agreement (this "Agreement") is a legal agreement between you ("You" "Your" or "User") and the United States Postal Service® ("USPS®" or "Postal Service"). The Agreement sets forth the terms and conditions for Your use of the USPS Fingerprint Capture and Submission Service performed by the USPS on behalf of the FBI ("Service") that allows You to provide Your fingerprints via biometric capture at select Post Office™ locations, which are then provided to the FBI. You acknowledge and agree that You are solely responsible for and shall abide by (i) the terms of this Agreement; (ii) the terms of use and guidelines of all Sites and Applications affiliated with the Service, and (iii) all policies, procedures and regulations of the United States Postal Service. User warrants, represents and agrees that use of the Service is for the sole purpose of obtaining fingerprints at select Post Office locations as required for submission to the FBI.

Modification of These Terms of Use and the Service

The Postal Service reserves the right to change the terms, conditions, and notices under which the Service is offered. You may review the most current terms and conditions of use at . If You do not agree to, or cannot comply with the Agreement as amended, You must stop using the Service. You will be deemed to have accepted the Agreement as amended if You continue to use the Service. User acknowledges and agrees that his or her use of the Service, in each instance, is subject to any such changes and that User's use of the Service constitutes acceptance of such changed terms. User agrees to review this Agreement from time to time to ensure compliance with these terms and conditions.

Description of Service

The Service allows You to register online (and may allow you to schedule an appointment) at participating Post Office locations in order to provide Your fingerprints and specific information needed for the FBI. The Postal Service is providing this Service on behalf of the FBI, and aside from holding the fingerprint and data temporarily until it is received by the FBI, no information is stored or collected by the USPS. In order to process Your fingerprints at a Post Office location, You must provide a photo ID using an approved photo identification, which may include a state-issued driver’s license; a U.S. Passport or U.S. Passport Card; or a Uniformed Services Identification Card.

NO REFUND POLICY

THERE ARE NO REFUNDS AVAILABLE THROUGH THE SERVICE WHETHER FOR FEES CHARGED BY THE POSTAL SERVICE OR ANY FEES CHARGED TO YOU BY THE FBI. THIS NO REFUND POLICY INCLUDES BUT IS NOT LIMITED TO INSTANCES WHERE THE TRANSFER OF FINGERPRINT BIOMETRIC DATA IS UNSUCCESSFUL.

Privacy

For over two centuries, the Postal Service has valued Your privacy, and built a brand that customers trust. When using the Service, your information is accessible to the Postal Service and the FBI and is governed by the Privacy Notice of the Service, and to the extent applicable, our privacy policy, available at www.usps.com/privacypolicy.

Any Personal Information collected from You and sent to the FBI is subject to the privacy policy of the FBI. The USPS and FBI encourage You to become familiar with and understand the privacy policies of the respective parties participating in the Service and such parties’ commitments to protection of Your data.

Intellectual Property - License Grant and Restrictions

This Service provided to You by the USPS is for User's and the FBI’s benefit. The Service and its underlying technology and systems are the intellectual property of the USPS, and are protected by law, including, without limitation, the copyright laws of the United States and other countries, and by international treaty provisions. Except as expressly stated herein, this Agreement does not grant You any intellectual property rights in the Service or the underlying technology and systems that comprise the Service. All rights therein not expressly granted are reserved by the USPS. Similarly, the technology and systems that comprise the USPS website or any USPS interface accessed as part of the Service are the intellectual property of the USPS, and are protected by law, including, without limitation, the copyright laws of the United States and other countries, and by international treaty provisions. This Section shall survive the termination or expiration of this Agreement for any reason.

User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service. You will need written permission from the Postal Service to reproduce, republish, upload, post, transmit, distribute or publicly display material from this Service.

USPS grants to You a limited, non-exclusive, non-transferable license to access and use the Service solely for the purpose of scheduling Your appointment and collecting Your fingerprints and associated data at select Post Office locations in order to provide such data to the FBI. Any violation by You of the license provisions contained herein may result in the immediate termination of Your right to use the Service. USPS reserves all right, title and interest not expressly granted under this license to the fullest extent possible under applicable laws. ANY USE OF THE SERVICE NOT SPECIFICALLY PERMITTED UNDER THIS AGREEMENT IS STRICTLY PROHIBITED.

Your Warranties, Representations and Responsibilities

When registering on this site ("Web Site") You agree that You will not:

use the Web Site to reproduce copyrighted or trademarked materials;
copy, store, edit, change, prepare any derivative work of, or alter in any way any of the information provided through the Web Site except for uses related to Your transaction effectuated through the Service;
make any attempt to circumvent the technological measure or measures that control access to or use of the Web Site, data, and documentation found on the Web Site, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction;
provide Your password, if a password is required by the Web Site, to any other person or entity;
translate, reverse engineer, decompile, disassemble, modify, or create derivative works based on the Web Site, or use any form of device, software, web bug, or spider to compile or glean data or information provided by the Web Site;
circumvent any technology used by the Postal Service to protect content accessible via the Web Site;
unbundle individual or component parts of the Web Site—including the Web Site’s code or data—for independent use;
rent, lease, or sublicense any of the information provided through the Web Site or products and services found on the Web Site; or
use Web Site in any way that violates the terms of this Agreement.

As between You and the Postal Service, You acknowledge that the Postal Service owns or has a license to all title and copyrights in and to the Web Site. All title and intellectual property rights in and to the content in or accessible by the Web Site is the property of the respective content owner (whether the Postal Service, a Postal Service contractor, or a licensor to the Postal Service) and may be protected by applicable copyright or other intellectual property laws and treaties and subject to use restrictions under such laws or treaties.

The Web Site contains the trademarks, service marks, graphics, and logos of the Postal Service and may contain third-party trademarks, copyrights service marks, graphics, and logos. You are not granted any right or license with respect to such Postal Service Marks or copyrights or the trademarks or copyrights of any third party.

You warrant and represent that You are the individual that is registering for and the individual that will use the Service; and that You are not participating in the Service by impersonating or acting on behalf of someone other than yourself.

No Warranties

THE POSTAL SERVICE (WHICH SHALL INCLUDE THE OFFICERS, EMPLOYEES AND AGENTS OF THE POSTAL SERVICE) SPECIFICALLY DISCLAIMS ANY RESPONSIBILITY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE. YOU AGREE THAT YOUR USE OF AND ACCESS TO THE SERVICE IS AT YOUR RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND AN “AS AVAILABLE” BASIS. THE POSTAL SERVICE DOES NOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SERVICE EXCEPT TO THE EXTENT ANY WARRANTY, CONDITION, REPRESENTATION OR TERM CANNOT OR MAY NOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW. THE POSTAL SERVICE MAKES NO REPRESENTATIONS, WARRANTIES, CONDITIONS, OR TERMS (EXPRESS OR IMPLIED WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE) AS TO THE SERVICE INCLUDING WITHOUT LIMITATION NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, INTEGRATION, SATISFACTORY QUALITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. THE PROVISIONS OF THIS SECTION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THIS AGREEMENT, FOR ANY REASON.

Limitation of Liability

IN NO EVENT SHALL THE POSTAL SERVICE (WHICH SHALL INCLUDE THE USPS’ OFFICERS, EMPLOYEES AND AGENTS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES, CLAIMS OR COSTS WHATSOEVER, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE LOSS ARISING OUT OF THIS AGREEMENT OR YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS OR GOODWILL, LOSS OF USE (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE) OR ANY CLAIM BY ANY THIRD PARTY OR IF THE SERVICE CANNOT BE PROVIDED (OR ANY PART THEREOF) OR FOR ANY FAILURE TO PERFORM ANY OBLIGATIONS CONTAINED IN THIS AGREEMENT DUE TO, DIRECTLY OR INDIRECTLY, THE FAILURE OF ANY EQUIPMENT OR ANY INDUSTRIAL DISPUTE, WAR, FLOOD, EXPLOSION, ACT OF GOD OR ANY OTHER EVENT BEYOND THE CONTROL OF THE USPS. YOU ACKNOWLEDGE AND AGREE THAT THIS LIMITATION OF LIABILITY FOR THE POSTAL SERVICE SHALL INCLUDE BUT NOT BE LIMITED TO ANY IDENTITY THEFT OR OTHER LOSSES ARISING OUT OF A BREACH OF SECURITY OF THE SERVICE, OR FOR ANY DAMAGES ARISING OUT OF CLERICAL ERRORS BY THE POSTAL SERVICE IN PERFORMANCE OF THE SERVICE.

IN ADDITION, NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, ALTHOUGH REASONABLE PRECAUTIONS WILL BE TAKEN TO PROTECT THE SERVICE AND AVOID DELETION, CORRUPTION OR UNAUTHORIZED MODIFICATION OR ACCESS OF OR TO THE SERVICE, AND TO PROVIDE THE SERVICE ERROR-FREE OR UNINTERRUPTED, NO REPRESENTATION OR WARRANTY OR CONDITION OF FITNESS OR MERCHANTABILITY SHALL BE CONSTRUED UNDER THIS AGREEMENT. THE USPS SPECIFICALLY DISCLAIMS ALL LIABILITY WHATSOEVER WITH RESPECT TO ANY FAILURE TO PROTECT THE SERVICE OR PROVIDE THE SERVICE ERROR-FREE OR UNINTERRUPTED. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THIS SERVICE OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE. THE PROVISIONS OF THIS SECTION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THIS AGREEMENT, FOR ANY REASON.

Indemnity

You acknowledge and agree to indemnify and hold the Postal Service (which shall include the USPS’ officers, employees and agents) harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of Your use of the Service or Your infringement of any third party rights by You while utilizing the Service. This Section shall survive the termination or expiration of this Agreement, for any reason.

Assignment

You may not assign this Agreement.

Governing Law and Jurisdiction

THIS AGREEMENT IS GOVERNED BY UNITED STATES FEDERAL LAW. USER AGREES THAT ALL DISPUTES AND MATTERS WHATSOEVER ARISING UNDER, IN CONNECTION WITH OR INCIDENT TO THIS AGREEMENT SHALL BE BROUGHT BY USER IN A FEDERAL COURT TO THE EXCLUSION OF THE COURTS OF ANY OTHER STATE OR COUNTRY.

Additional Provisions

The Postal Service's performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of the Postal Service's right to comply with governmental, court and law enforcement requests or requirements relating to Your use of this Service or information provided to or gathered by the Postal Service with respect to such use. Accordingly, the Postal Service reserves the right at all times to disclose any information You provide using the Service as necessary to satisfy any applicable law, regulation, legal process or governmental request.

The Service is void where prohibited by law. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect, remain valid and be enforceable according to its terms. The failure to enforce any term of this Agreement on one occasion shall not prevent enforcement on any other occasion or the enforcement of any other term. Headings and captions shall not be considered included for purposes of interpretation or application hereof, but are for convenience only.

This Agreement constituteS the entire agreement between You and the Postal Service with respect to this Service and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and the Postal Service with respect to this Service. You may not amend this Agreement. This Agreement is in addition to any agreement between You and the FBI. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Disclaimer of endorsement

Reference herein to any specific commercial products, process, or service by trade name, trademark, manufacturer, or otherwise, does not necessarily constitute or imply its endorsement, recommendation, or favoring by the United States Government or the Postal Service. The views and opinions of authors expressed herein do not necessarily state or reflect those of the United States Government or the Postal Service, and shall not be used for advertising or product endorsement purposes.
